These Hardware & Sensor Terms ("Hardware Terms") govern the use of any sensors, gateways, or IoT devices provided, sold, leased, or supported by SafeLogs ("Hardware"). These Hardware Terms are incorporated by reference into the SafeLogs Terms of Service.
1. PURPOSE AND LIMITATIONS
SafeLogs Hardware is provided solely as a monitoring and documentation aid.
Hardware:
- Does not guarantee accuracy
- Does not ensure regulatory compliance
- Does not prevent equipment failure, food loss, or safety incidents
- Does not replace manual checks or required procedures
Customer remains solely responsible for operational decisions, verification, and compliance.
2. OWNERSHIP AND TITLE
Unless otherwise stated in writing:
- Hardware is either sold to Customer or provided for use in connection with a subscription, as specified at purchase.
- SafeLogs retains all intellectual property rights in Hardware firmware, software, and designs.
- Customer receives no ownership rights beyond the right to use Hardware as intended.
3. INSTALLATION AND ENVIRONMENT
Customer is solely responsible for:
- Proper installation and placement
- Ensuring adequate power, connectivity, and environmental suitability
- Compliance with electrical, safety, and building codes
- Securing devices from tampering or damage
SafeLogs is not responsible for failures caused by improper installation, placement decisions, environmental conditions, or third-party infrastructure.
4. SENSOR DATA AND ACCURACY DISCLAIMER
Sensor data may be affected by:
- Physical placement
- Ambient conditions
- Obstructions
- Signal interference
- Battery condition
- Network availability
- Device calibration drift
SafeLogs does not guarantee:
- Accuracy
- Completeness
- Timeliness
- Continuous data transmission
False positives, false negatives, missed alerts, or delayed readings may occur.
5. CONNECTIVITY DEPENDENCIES
Hardware functionality depends on third-party systems, including:
- Internet service providers
- Cellular or LoRaWAN networks
- Power supply
- Customer network configurations
SafeLogs is not responsible for outages, delays, or data loss caused by these dependencies.
6. MAINTENANCE AND CUSTOMER OBLIGATIONS
Customer is responsible for:
- Monitoring device status
- Replacing batteries when required
- Performing physical inspections
- Responding to alerts appropriately
- Ensuring continued suitability of placement
Failure to maintain Hardware may result in inaccurate data or service interruption.
7. WARRANTY DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HARDWARE IS PROVIDED "AS IS" AND "AS AVAILABLE"
- SAFELOGS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY
- NON-INFRINGEMENT
Any limited warranty, if offered, is governed by separate written terms.
8. LIMITATION OF LIABILITY
SAFELOGS IS NOT LIABLE FOR:
- FOOD SPOILAGE OR LOSS
- PROPERTY DAMAGE
- BUSINESS INTERRUPTION
- REGULATORY FINES OR PENALTIES
- SAFETY INCIDENTS
- RELIANCE ON SENSOR DATA
- MISSED OR DELAYED ALERTS
SAFELOGS' TOTAL LIABILITY RELATED TO HARDWARE SHALL NOT EXCEED THE AMOUNT PAID FOR THE HARDWARE AT ISSUE.
9. INDEMNIFICATION
Customer agrees to indemnify and hold harmless SafeLogs from any claims arising from:
- Installation or use of Hardware
- Reliance on sensor data
- Customer operational decisions
- Violations of law or regulation
- Injury, loss, or damage related to Hardware use
10. TERMINATION AND DECOMMISSIONING
Upon termination of Services:
- Hardware functionality may be limited or disabled
- Customer is responsible for proper disposal or return if required
- SafeLogs has no obligation to support Hardware after termination
11. MODIFICATIONS AND UPDATES
SafeLogs may update Hardware firmware or functionality remotely to maintain compatibility, security, or performance.
12. CHANGES TO THESE TERMS
SafeLogs may update these Hardware Terms from time to time.
Continued use of Hardware constitutes acceptance of updated terms.
